A WELWYN Garden City man caught flashing himself from a car in broad daylight was jailed yesterday.
David McDonald, of Dunsters Mead, was on a probation supervision order when he pulled up in a Potters Bar road and was seen by two women exposing himself.
Tayo Hassan, prosecuting, told the court: “Mr McDonald was seen by two independent female witnesses parked in a Citroen Saxo in Mutton Lane around 7.30am on Saturday, October 3 this year.
“He only had a black t-shirt on and nothing else and was sat with a porno mag held up with his left hand and his right hand between his legs.”
She continue by telling how the second pedestrian “could not believe what she had seen.” She saw him in the drivers seat with the door wide open and realised he had no clothes on the bottom half.
Miss Hassan added: “He made eye contact with her and put the magazine out of view, looked at her, and lifted the magazine up and made it blatantly obvious he had seen her and continued only faster and more furious because it was turning him on.”
The 37-year-old was found guilty of indecent exposure at St Albans Magistrates Court in November after contesting a trial and the sentencing was adjourned while reports were prepared.
The court heard how McDonald, who had a history of alcohol abuse, failed to keep appointments with his probation and so the magistrates decided to sentence without reports.
Mr Bashir, defending, told the court in mitigation his client had not committed any offences for two-and-a-half years, and that he still denied this offence.
He said: “He does not accept the decision of the court and following the sentence will be making an appeal.
“Therefore it is difficult to address you about his version of events.”
While the bench retired to deliberate McDonald’s fate he rolled himself a cigarette casually smoking it in the locked dock and setting off the smoke alarm.
The six month prison sentence was imposed as a usher walked around the room spraying air freshener and the chairman of the bench explained it was “prolonged over a period of time” and was aggravated by the fact it was committed while on a community order for the same offence.
Asked if he understood McDonald said: “Yes I understand but you are wrong” then raised his middle finger towards the magistrates as he was led away to serve half the sentence before release.
