DEVELOPER Helioslough has confirmed it will be seeking its costs from the district council as the inquiry resumes on its third week.

Barrister Martin Kingston told inspector Andy Mead he had already written to the authority about the matter, adding meaningfully: "That may need to be modified in light of other things that have taken place."

The council's barrister Mattew Reed said he needed more details before he could give a detailed written response.

Whatever the result of the appeal, either side could apply for its costs, but would have to prove the other side had acted unreasonably, for example by pusuing issues resolved by the first inquiry.
